Distance Sales Agreement

Buyer: the owner of the organization account whose name, email and billing details are collected at the payment step.

This agreement sets out the parties' rights and obligations under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation. If the Buyer is not a consumer (buys for commercial or professional purposes), provisions specific to consumer law do not apply; all other provisions apply as written.

The service is subscription access to the VIBE TO GEO software under the chosen plan: measuring brand visibility in Ai answers, competitor and source analysis, action suggestions, reports and the other features the plan includes.

Each plan's number of brands, monthly credits, queries, scan frequency and features are shown on the pricing page and at the payment step. A credit is the unit of measurement calls made to the engines; the monthly allowance renews at the start of each period and does not roll over. When credits run out no new measurements are made and nothing extra is charged.

The service is delivered online; there is no physical delivery. Results rely on answers from third-party Ai providers, which the Seller does not control.

Prices are published on the pricing page. This agreement contains no fixed amounts; the amount shown at the payment step and written to the order record applies. Buyers whose billing country is Türkiye pay in Turkish lira including VAT; buyers abroad pay in US dollars without VAT (export of services). The billing country determines the currency.

Payment is taken by card through iyzico, a payment institution licensed under Law No. 6493. Card details never reach and are never stored by the Seller. So that the subscription can renew, the card is stored in iyzico's card vault and used only for charges under this agreement.

For charges in a foreign currency, the amount on the card statement may differ with the Buyer's bank's exchange rate. If a payment is not approved or is later reversed, the service is not started or is suspended. The Seller issues an invoice for every charge and sends it by email.

Paid plans start with a 7-day free trial. Card details are required; nothing is charged during the trial. If the Buyer cancels before the trial ends, nothing is charged. Otherwise the first period is charged to the stored card when the trial ends. This trial applies to Buyers whose billing country is Türkiye. Buyers outside Türkiye have no trial and instead a 14-day money-back guarantee on every payment, as set out on the Delivery, Cancellation and Refunds page.

The service starts immediately and electronically once payment is approved (for a trial start, once the card is verified): the plan is assigned to the Buyer's organization, credits are opened and measurements can start. The service runs for the chosen period and renews automatically at its end.

Under Article 15(1)(ğ) of the Distance Contracts Regulation, the right of withdrawal does not apply to services performed instantly in electronic form, and under Article 15(1)(h) to services whose performance began with the consumer's approval before the withdrawal period ended.

At the payment step the Buyer ticks a separate box confirming that they ask for the service to start immediately and know that they therefore have no right of withdrawal. The order cannot be completed without this consent, which is recorded with its date and time.

The absence of a withdrawal right does not remove free cancellation during the trial or the refund cases below.

Unless the Buyer cancels, the subscription renews at the end of each chosen period (monthly or yearly) for the same plan and period, and the price is charged to the stored card.

A price change is not applied to an existing subscription until the new amount and its effective date have been emailed to the Buyer at least 30 days in advance. A Buyer who does not accept the new price may cancel before it takes effect.

A Buyer with a paid subscription may buy one-off credit packs on top of the monthly credit allowance. Pack sizes and prices are shown on the Billing page; the amount shown at the payment step when ordering applies. The pack price is charged once and does not renew automatically.

Purchased credits are added to the Buyer's organization immediately once payment is approved and are valid for 12 months from purchase. The monthly allowance is used first, then purchased credits; with several packs, the one expiring soonest is used first. Purchased credits are not removed at the monthly renewal and remain usable for their validity even if the subscription ends. Expired credits cannot be used.

Credits cannot be exchanged for cash or transferred to another organization. The withdrawal exception applies to credit packs as well: at the payment step the Buyer separately confirms that the credits are added immediately. Unused or expired credits are not refunded; refunds for credits not being added despite payment and for duplicate charges remain available.

The Buyer can cancel at any time from the Billing page in the panel or by writing to info@vibetogeo.com. Cancellation takes effect at the end of the current period; the service continues until then and unused time is not refunded.

The amount charged is refunded if: access to the service was never opened despite payment; the same period was charged more than once (the excess); or the Seller permanently ends or substantially narrows the service during a period (pro rata for the remaining time). Refunds go to the card used, within 14 days of the refund decision. Details are on the Delivery, Cancellation and Refunds page.

The Buyer states that the information given is accurate, that the card used is theirs or they are authorized to use it, and that they will comply with the Terms of Use. The Buyer is responsible for the security of the account and organization.

The Buyer's personal data is processed for the purposes set out in the KVKK Notice and the Privacy Policy. Payment data is processed by the payment institution; the card number never reaches the Seller.

Disputes arising from this agreement are heard, within the monetary limits announced each year by the Ministry of Trade, by the consumer arbitration committees at the Buyer's or Seller's place of residence, and above those limits by consumer courts. If the Buyer is not a consumer, the courts and enforcement offices of İzmir have jurisdiction. The agreement is governed by Turkish law.

The Seller's electronic records (order record, accepted agreement version and time, consent to immediate performance, payment institution records) serve as evidence in disputes.

The Buyer states that they have read this agreement and the Pre-sale Information Form and accepted them electronically at the payment step. The agreement enters into force when payment is approved (for a trial start, when the trial begins), and a copy is sent to the Buyer's email address.
